Hourly rates, unless agreed to otherwise in advance, include four-hour minimum, inclusive of scheduling, file set-up, correspondence, pre-hearing telephone calls, preparation, review of briefs, travel and mediation or arbitration. There is no charge for mileage, parking, postage or photocopies.  For travel expenses outside of the greater Bay Area, air fare may need to be paid,  see below.

Half day and full day packages (Mediation Only) may be more attractive as they include all scheduling, file set-up, correspondence, pre-hearing telephone calls, preparation, review of briefs, travel time in the greater Bay Area, and the mediation.

Please call if you have questions regarding fees.  My guiding principle is to make alternative dispute resolution cost effective and affordable.  It should be a small fraction of the ultimate costs of litigation.

 

Scheduling Notes

Cancelation & Rescheduling

In the event of cancellation of a scheduled mediation or arbitration (including pre-arbitration conferences), without rescheduling with more than five business days’ notice, fees will be charged for services preceding cancellation on an hourly basis.  There is a two-hour minimum fee in the event of cancellation without rescheduling with fewer than five business days’ notice or in the event of rescheduling with fewer than three business days’ notice.  If a matter can be rescheduled in the same or next calendar week, the fee will be waived.

Fee Responsibility

In the absence of any agreement otherwise, in civil matters it is assumed that the fee will be shared equally by all parties, and in Workers’ Compensation matters, the fee will be paid by the defendants.

The fees are the responsibility of the attorneys and firms who schedule the matter, irrespective of any third-party responsibility for payment.

 

Travel

There is no charge for mileage, parking, postage or photocopies. For travel expenses outside of the greater Bay Area, air fare may need to be paid, see below.

No charge for travel in San Francisco or the East Bay including hearings elsewhere in the greater Bay Area, San Jose, Stockton, Santa Rosa and Sacramento.  Mr. Russo handles all disputes in California and will travel outside the state as well. Arrangements should be discussed for hearings outside of the greater Bay Area.

Video Conferencing

Mediation and arbitrations remotely and successfully provided since 2019 through secure video conferencing services as an alternative if requested. Click here here to learn more.
